Terms of Service

By accessing or using the Yarune AI Infrastructure Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users, including visitors, registered users, and enterprise customers.

If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms, and "you" refers collectively to you and that entity.

If you do not agree to these Terms, you must not access or use the Service. Pthahnil LLC reserves the right to update these Terms at any time, with notice provided as described in Section 14.

Yarune provides an AI infrastructure platform that includes, but is not limited to:

• Model inference API with support for open-source and custom AI models
• Model fine-tuning and deployment tooling
• Observability dashboard with request tracing, analytics, and alerting
• Global edge inference network across multiple regions
• SDKs, developer tools, and documentation
• Webhook and event streaming integrations

Yarune reserves the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

To access most features of the Service, you must register for an account. When registering:

• You must provide accurate, current, and complete information
• You must be at least 16 years of age (or the minimum age in your jurisdiction)
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

Access to Yarune's APIs is subject to the following terms:

Rate Limits: Each plan is subject to rate limits on requests per second, daily token consumption, and concurrent connections. Exceeding rate limits may result in throttled responses or temporary suspension of API access.

Fair Use: You agree not to use the API in ways that unreasonably burden our infrastructure or degrade service quality for other users.

API Keys: You are responsible for safeguarding your API keys. Do not share keys publicly, commit them to version control, or embed them in client-side code. Yarune is not liable for unauthorized use of your API keys.

Versioning: We will provide at least 90 days notice before deprecating a major API version. We recommend subscribing to our changelog to stay informed of upcoming changes.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate, distribute, or facilitate harmful, illegal, or misleading content
• Develop or deploy weapons, malware, surveillance tools, or other dangerous systems
• Infringe intellectual property rights of any third party
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Probe, scan, or test the vulnerability of our systems without authorization
• Circumvent authentication, access controls, or usage limits
• Resell or sublicense API access without prior written approval from Yarune
• Generate content that exploits, harms, or threatens minors
• Engage in any activity that interferes with or disrupts the Service

Violations of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

Subscription Plans: Yarune offers monthly subscription plans billed in advance. You authorize us to charge your payment method on a recurring basis until you cancel.

Usage-Based Charges: Certain usage beyond your plan limits may incur additional charges. These charges are calculated based on actual usage and billed at the end of each billing cycle.

Taxes: Prices are exclusive of taxes. You are responsible for all applicable taxes, levies, or duties imposed by taxing authorities.

Refunds: All fees are non-refundable except as required by law or as explicitly stated in our refund policy. Unused credits or pre-paid amounts are non-refundable upon account cancellation.

Failed Payments: If payment fails, we may suspend access to the Service after a grace period. We will notify you by email before suspension.

Yarune's IP: The Service, including all software, algorithms, interfaces, documentation, trademarks, and content provided by Yarune, is owned by Yarune, Inc. and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service as permitted by these Terms.

Your Content: You retain ownership of any data, prompts, or outputs you input or generate through the Service ("Your Content"). By using the Service, you grant Yarune a limited license to process Your Content solely to operate and provide the Service.

Feedback: If you submit feedback, suggestions, or feature requests, you grant Yarune a royalty-free, perpetual license to use such feedback for any purpose without compensation to you.

Each party may have access to the other party's confidential information in connection with the Service. "Confidential Information" includes API keys, business plans, technical specifications, pricing, and any information marked as confidential.

Each party agrees to: (i) keep confidential information strictly confidential; (ii) not use it for purposes outside of these Terms; and (iii) disclose it only to employees or contractors who need to know, subject to obligations at least as protective as these Terms.

For Enterprise customers, confidentiality terms in your Enterprise Agreement shall supersede this section where applicable.

Yarune targets the following uptime commitments by plan:

Planned maintenance windows are excluded from uptime calculations. Yarune will provide at least 48 hours advance notice for scheduled maintenance.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PTHAHNIL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL PTHAHNIL LLC'S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PTHAHNIL LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

By You: You may cancel your account at any time via the account settings page. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused time.

By Pthahnil LLC: We may suspend or terminate your access immediately if you violate these Terms, engage in fraudulent activity, fail to pay amounts due, or if continued service poses legal or security risk to Pthahnil LLC or other users.

Effect of Termination: Upon termination, your right to use the Service ceases. Sections on Intellectual Property, Disclaimer, Limitation of Liability, and Governing Law survive termination.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class action lawsuits and class-wide arbitrations are not permitted. You waive any right to participate in a class action against Pthahnil LLC.

Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

Entire Agreement: These Terms, together with our Privacy Policy and any applicable Enterprise Agreement, constitute the entire agreement between you and Pthahnil LLC regarding the Service.

Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Waiver: Failure by Pthahnil LLC to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. Pthahnil LLC may assign these Terms in connection with a merger, acquisition, or sale of assets.

We reserve the right to modify these Terms at any time. We will provide at least 30 days advance notice for material changes via email notification and in-app banner. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

For Enterprise customers, changes to these Terms shall not take effect until the end of your current contract term, unless required by applicable law.
